The Right to Health in the Social Rule of Law: The Case of Greece

This paper explores the right to health as part of a social right in the Greek legal order. The study begins with the historical formation of the welfare state and the social state and then analyses the constitutional foundation of the “Social Rule of Law” in the Greek constitutional order. Furthermore, there is reference to the connection between the social rule of law and social justice in the health sector. There is no doubt that social justice, social state, equality and redistribution are components of the right to health. The “welfare state” describes the institutional organisation of social services and the “social state” constitutes a regulatory principle of the Constitution. The paper concludes with the presentation of proposals that contribute to the promotion of the principles of social justice and social state in Greece in the health sector.

Cet article explore le droit à la santé en tant que partie d’un droit social dans l’ordre juridique grec. L’étude commence par la formation historique de l’État providence et de l’État social et analyse ensuite le fondement constitutionnel de “l’État de droit social” dans l’ordre constitutionnel grec. En outre, il fait référence au lien entre l’État de droit social et la justice sociale dans le secteur de la santé. Il ne fait aucun doute que la justice sociale, l’État social, l’égalité et la redistribution sont des composantes du droit à la santé. “L’État providence” évoque l'organisation institutionnelle des services sociaux et “l’État social” constitue un principe réglementaire de la Constitution. L’article se termine par la présentation de propositions qui contribuent à la promotion des principes de justice sociale et d’État social en Grèce dans le secteur de la santé.
