The Evolution of the Immigration and Asylum Policy of the European Union - From the Internal Market to the New Pact

In this contribution, the historical elements which have contributed to the development of a common immigration and asylum law and policy of the European Union are discussed, as are the shortcomings that manifested themselves during the application in practice of the current legislative instruments. The New Pact on Migration and Asylum, agreed between the European Parliament and the Council in May 2024, represents a new and comprehensive approach of the Union in these policy areas. Some important reforms, introduced by the New Pact, are also dealt with, such as innovations in the external border control arrangements; the principle of ‘flexible solidarity’ to be applied in the process to designate the so-called ‘responsible’ member state to examine applications for international protection of migrants; and new ideas regarding the cooperation with third countries on the return of migrants who have no right to remain in the European Union.

Dans cette contribution, les éléments historiques qui ont contribué au développement d’un droit et d’une politique communs de l’Union européenne en matière de migration et d’asile sont examinés, ainsi que les lacunes qui se sont manifestées lors de la mise en œuvre dans la pratique des instruments législatifs actuels. Le Nouveau Pacte sur la Migration et l’Asile, convenu entre le Parlement européen et le Conseil au mois du mai de 2024, représente une approche nouvelle et globale de l’Union dans ces domaines politiques. Certaines réformes importantes, introduites par le Nouveau Pacte, sont aussi abordées,telles que des innovations dans les dispositions de contrôle des frontières extérieures; le principe de “solidarité flexible” à être appliqué dans le processus de désignation de l’État membre dit “responsable” d’examiner les demandes de protection internationale des migrants; et de nouvelles idées concernant la coopération avec les pays tiers sur le retour des migrants qui n’ont pas le droit de rester dans l’Union européenne.
