General Conclusions: The Problem is Real, the Response is Difficult

The conclusions to this meeting of the EPLO consider the underlying nature and causes of the rule of law problem, including democratic backsliding and authoritarian populism. This is followed by consideration of the EU’s response. This part of the discussion is divided into the following six sections, the first three of which deal with the following issues: responsibility and response; response and competence; response and judicial independence. This is followed by three sections which consider response and institutional constraint from the perspective of the Council, the EP and the broader political context in the EU Member States.

Les conclusions de cette réunion de l’EPLO examinent la nature et les causes sous-jacentes du problème de l’État de droit, y compris le recul démocratique et le populisme autoritaire. La réponse de l’UE est ensuite examinée. Cette partie de la discussion est divisée en six sections, dont les trois premières traitent des questions suivantes: responsabilité et réponse; réponse et compétence; réponse et indépendance judiciaire. Suivent trois sections qui examinent la réponse et les contraintes institutionnelles du point de vue du Conseil, du PE et du contexte politique plus large dans les États membres de l’UE.
