Compliance with the Rule of Law in the Case-law of the Court of Justice of the European Union – Some Considerations

The principle of the ‘Rule of Law’ did not expressly feature in the original Treaties. It was the Court of Justice that, for the first time, referred to the then European Economic Community as ‘a Community based on the Rule of Law’, in the Les Verts judgment of 1986. Some forty years later, in Associação Sindical dos Juízes Portugueses, that principle was again strongly re-affirmed by the Court, in a decision that proved to be very consequential. This paper aims at exploring the evolution of the principle of the Rule of Law in the case-law of the Court, in order to illustrate the significance of that principle within the EU legal order. It concludes by emphasising that the principle of the Rule of Law serves, in particular, the fundamental objective to ensure that, in the European Union, all individuals and Member States are equal before the law.

Le principe d’“État de droit” ne figurait pas expressément dans les traités originaux. C’est la Cour de justice qui, pour la première fois, a qualifié ce qui était alors la Communauté économique européenne de “Communauté de droit”, dans l’arrêt Les Verts de 1986. Quelque quarante ans plus tard, dans l’affaire Associação Sindical dos Juízes Portugueses, ce principe a été réaffirmé avec force par la Cour, dans un arrêt qui s’est avéré très important. Cet article vise à explorer l’évolution du principe d’État de droit dans la jurisprudence de la Cour, afin de montrer l’importance de ce principe dans l’ordre juridique de l’UE. Il conclut en soulignant que le principe d’État de droit sert, en particulier, l’objectif fondamental de garantir que, dans l’Union européenne, tous les individus et tous les États membres sont égaux devant la loi.
