ИНСТИТУТ ОМБУДСМЕНА, КАК ВАЖНЫЙ МЕХАНИЗМ ЗАЩИТЫ ПРАВ ЧЕЛОВЕКА

The development of the legal system of each State is directly linked with the effective mechanisms of protection of human rights and fundamental freedoms. For a civilized society man, his rights and fundamental freedoms are the highest values and all necessary and possible measures are taken in order to create the most effective mechanisms to protect human rights and fundamental freedoms. The rapid development of democratic values throughout the world requires improvement of the existing and creation of new legal mechanisms aimed at ensuring human rights. In the legal systems of civilized countries, the institution of the Ombudsman is considered to be one of the most important mechanisms for protecting human rights and fundamental freedoms and for strengthening the legality in the activities of public authorities. Of course, in the Republic of Armenia, where democratic values are rapidly evolving, exists the institution of the Ombudsman, that successfully functions. The purpose of this article is to show the importance of the institution of the Ombudsman, to reveal the characteristics of the activities of Ombudsmen from different countries, to present the particularities of the legislative regulation of the Ombudsman Institution of the Republic of Armenia, the positive and negative aspects of that regulation and the legislative reforms that will help to improve the work of the Ombudsman institution.
Развитие правовой системы каждого государства прямым образом связано с эффективностью механизмов защиты прав и основных свобод человека. Для цивилизованного общества-человек, его права и основные свободы являются высочайшими ценностям и принимаются все необходимые и возможные меры для создания наиболее эффективных механизмов защиты прав и основных свобод человека. Стремительное развитие демократических ценностей во всем мире требует совершенствования действующих и создания новых правовых механизмов, направленных на обеспечение прав человека. Институт омбудсмена в правовых системах цивилизованных стран по справедливости считается важным механизмом защиты прав и ос-новных свобод человека и укрепления законности в деятельности го¬сударственных органов. Естественно, что в Республике Армения, где демократические ценности стремительно развиваются, существует институт омбудсмена, который довольно удачно функционирует. Цель данной статьи-показать важность института омбудсмена, раскрыть характерные черты деятельности омбудсменов разных стран, представить особенности законодательного регулирования института омбудсмена Республики Армения, положительные и отрицательные аспекты этого регулирования и те законодательные реформы, которые помогут улучшить работу института омбудсмена.
