Crise de la démocratie et construction européenne

The Western system of liberal democracy is in crisis. In fact, democracy is malfunctioning because of the disconnection between the vote and the political decisions taken by the elected officials. The Western system is a mixed system, democratic and liberal, and if we wish to understand this crisis, these two elements should not be confused. If the law is, first, one of the conditions of democracy, the straight jacket into which the law is likely to place political power, in the name of a liberal conception, can however lead to a weakening of democratic mechanisms. The changes affecting the nation-state, the natural cradle of democracy, do affect this principle of legitimacy of power, and tend to weaken political power. In this context, it is worth reflecting upon the mechanisms that would allow to revitalize democracy, in particular the tools of participatory democracy and the referendum.
Le système occidental de démocratie libérale est en crise. En fait, la démocratie fonctionne mal du fait de la déconnexion qui s’établit entre le vote et les décisions politiques prises par les élus. Le système occidental est un système mixte, démocratique et libéral, et, si l’on veut comprendre cette crise, il convient de ne pas confondre ces deux éléments. Si le droit est d’abord l’une des conditions de la démocratie, le carcan dans lequel le droit est susceptible d’enserrer le pouvoir politique, au nom d’une conception libérale, peut cependant conduire à un affaiblissement des mécanismes démocratiques. Les mutations qui affectent l’Etat-nation, berceau naturel de la démocratie, ne sont pas sans incidences sur ce principe de légitimation du pouvoir, et tendent à affaiblir le pouvoir politique. Dans ce contexte, il convient de s’interroger sur les mécanismes qui permettraient de revivifier la démocratie, notamment les outils de la démocratie participative et le référendum.
