The Core of the Right to Education: The Academic Freedom

In this article we treat the core of the right to education, academic freedom, which was protected during the economic crisis of 2009 by the supreme judges of Southern Europe. Starting from Greece, we cite an example that shows a missed opportunity concerning the protection of liberty of religious consciousness in education. According to the case law of the economic crisis, academic freedom constitutes unlimited scientific freedom of thought and autonomy on the one side of the institutions and on the other side of the state. We also examine the notion of academic freedom and its limits in the European Convention on Human Rights and in the case law of the Strasbourg Court. According to this case law, academic freedom prohibits the abuse of any dominant position. By citing examples, one observes the continuity of the concept of academic freedom over time.
Dans cet article on traite le noyau dur du droit à l’éducation, la liberté académique, qui a été protégé pendant la crise économique de 2009 par les juges suprêmes de l’Europe du Sud. En commençant par la Grèce on cite un exemple qui montre une opportunité manquée concernant la protection de la liberté de la conscience religieuse au niveau de l’éducation. Selon la jurisprudence de la crise économique, la liberté académique constitue la liberté scientifique illimitée de pensée et l’autonomie d’un côté des institutions et de l’autre côté de l’Etat. On examine également la notion de la liberté académique et ses limites dans la Convention européenne des droits de l’homme et dans la jurisprudence de la Cour de Strasbourg. Selon cette jurisprudence, la liberté académique interdit l’abus de position dominante. En citant des exemples, οn observe la continuité de la notion dans le temps.
