Does the Basic Law Allow Germany to Leave the European Union?

Until now no important political party in Germany calls for leaving the European Union. Although the Basic Law includes the goal to participate in a united Europe, the Federal Constitutional Court has made some unclear remarks that Germany has the power to unilaterally leave the Union. Scholars in constitutional law are divided on the subject. There are convincing arguments that an exit would require an amendment of the Basic Law abolishing the goal to strive for a united Europe.

Jusqu’à présent, aucun parti politique important en Allemagne ne demande à quitter l’Union européenne. Bien que la Loi fondamentale inclue l’objectif de participer à une Europe unie, la Cour constitutionnelle fédérale a fait quelques remarques peu claires sur le pouvoir de l’Allemagne de quitter unilatéralement l’Union. Les spécialistes du droit constitutionnel sont divisés sur le sujet. Il existe des arguments convaincants selon lesquels une sortie nécessiterait une modification de la Loi fondamentale abolissant l’objectif d’œuvrer pour une Europe unie.
