Rule of Law and Judicial Appointments

An independent judiciary is an essential component of the rule of law. One of the key points for exerting influence on the judiciary is the appointment of judges. In Europe, the appointment takes place in a variety of ways. The European minimum standards for judicial appointments must reflect this diversity, which is often the result of long-standing national traditions. But these differences do not prevent compliance with the requirements of the rule of law. The CJEU, thus, does not provide a ‘one size fits all’ formula for conducting the overall assessment. However, it does provide guidelines as to which aspects should be included. This article tries to give an overview of the European jurisdiction in terms of the rule of law and the appointment of judges and focusses on specific aspects where the rule of law could be endangered.

L’indépendance du pouvoir judiciaire est une composante essentielle de l’État de droit. L’un des points clés pour exercer une influence sur le pouvoir judiciaire est la nomination des juges. En Europe, la nomination se fait de différentes manières. Les normes minimales européennes en matière de nomination des juges doivent refléter cette diversité, qui est souvent le résultat de traditions nationales anciennes. Mais ces différences n’empêchent pas le respect des exigences de l’État de droit. La CJUE ne propose donc pas de formule unique pour procéder à l’évaluation globale. Cependant, elle fournit des lignes directrices sur les aspects à prendre en compte. Cet article tente de donner une vue d’ensemble de la juridiction européenne en termes d’État de droit et de nomination des juges et se concentre sur des aspects spécifiques où l’État de droit pourrait être mis en danger.
