THE SOLIDARITY PRINCIPLE AT STAKE

This report deals with the concept of solidarity laid down in the Spanish Constitution. To do so, it begins by analyzing the particular constitutional provisions from which the concept of solidarity can be deduced, subsequently it describes the doctrinal contributions that propose to construct solidarity as a general constitutional value. Within that framework, the report assesses the recent austerity measures adopted by the Spanish Government and seeks to ascertain whether, under the current legal reforms, solidarity has been taken into consideration or, on the contrary, it has been affected by the adoption of new rules for the entitlement to social security rights, access to health services or litigation fees, among others. The authors find evidence of a certain impact of solidarity in the legal field, especially when it is linked to other constitutional principles and rights.
Ce rapport traite du concept de solidarité prévu dans la Constitution espagnole. Pour ce faire, il commence par analyser les dispositions constitutionnelles particulières dont la notion de solidarité peut ressortir. Puis il décrit les contributions doctrinales qui proposent d'ériger la solidarité en valeur constitutionnelle générale. Dans ce cadre, le rapport évalue les récentes mesures d'austérité adoptées par le gouvernement espagnol et cherche à établir si les réformes juridiques actuelles ont pris la solidarité en considération ou si, au contraire, elle a été affectée par l'adoption de nouvelles règles sur les droits à la sécurité sociale, l'accès aux services de santé ou les frais de contentieux, entre autres. Les auteurs trouvent la preuve d'un certain impact de la solidarité dans le domaine juridique, notamment quand elle est liée à d'autres principes et droits constitutionnels.
