Rights across Borders: Citizenship and Immigration in Europe

This paper gives an account of international and national law in the area of nationality. It highlights some recent developments and trends in this field and identifies a number of problems relating to nationality rights across borders, among other things concerning uncertainty about EU legal competence within this domain, controversies surrounding European integration, the economic crisis, the refugee crisis, large-scale migration and gruesome terrorist attacks. Against this background, it discusses the need for a framework to resolve problems concerning nationality matters. It argues that there is a need for increased European cooperation and coordination in this area and that member states of the Council of Europe and/or the EU should take steps to establish a suitable forum for a discussion of shared principles in relation to the acquisition and loss of nationality and, eventually, the setting of new standards.
Cette étude rend compte du droit international et national en matière de nationalité. Elle met en évidence quelques développements et tendances récents en ce domaine et identifie un certain nombre de problèmes liés aux droits de la nationalité qui dépassent les frontières, concernant entre autres l’incertitude sur la compétence légale de l’UE en ce domaine, les controverses au sujet de l’intégration européenne, la crise économique, la crise des réfugiés, la migration à vaste échelle et les épouvantables attaques terroristes. Dans ce contexte, elle discute de la nécessité d’un cadre pour résoudre les problèmes en matière de nationalité. Il plaide pour la nécessité d’intensifier la coopération et la coordination européenne en ce domaine et soutient que les Etats membres du Conseil de l’Europe et/ou de l’UE devraient prendre des mesures pour établir un forum adéquat de discussion concernant des principes partagés relatifs à l’acquisition et à la perte de la nationalité et, finalement, l’adoption de nouveaux standards.
