Rights of Foreigners in Denmark

The paper considers, from an EU perspective, the rights of foreigners in Denmark and the consequences of the Danish opt-outs from the EU cooperation. Due to the opt-out from justice and home affairs, as a rule, Denmark does not participate in acts in this area and is not bound by them. However, special procedures for acceding to EU instruments make Danish participation possible in selected areas. Still, no accession has taken place in respect of the most important EU instruments granting rights to third country nationals. An outline of the Danish legal system relating to immigration is given, measures taken in order to combat terrorism are described and the implications of a Danish decision to join the other EU Member States in implementing important instruments concerning third-country nationals’ rights are discussed.
