The Polish Constitutional Tribunal and its Transformation

This paper analyzes the mechanisms used to transform the Polish Constitutional Tribunal (CT) into an unconstitutional institution subordinated to the governing party. This transformation was achieved by court-packing and a series of unconstitutional statutes adopted by the parliamentary majority in order to amend the constitutional positions on the CT outside of the constitutional amendment procedures. The paper presents the methods used by organs with legislative and executive powers to change the CT’s character, composition, manner of operating and the scope of its competences, in addition to its position within the system of State organs. These methods include, among others, the duplication of Tribunal judges and the adaptation of a law paralyzing the activity of this institution.
Ce document analyse les mécanismes utilisés pour transformer le Tribunal constitutionnel polonais (TC) en une institution inconstitutionnelle subordonnée au parti au pouvoir. Cette transformation a été réalisée au moyen du “court-packing” (noyautage) et d’une série de lois inconstitutionnelles adoptées par la majorité parlementaire afin de modifier les positions constitutionnelles concernant le TC en dehors des procédures d’amendement constitutionnel. Le présent document présente les méthodes utilisées par des organes dotés de pouvoirs législatifs et exécutifs pour modifier le caractère, la composition, le mode de fonctionnement et l’étendue des compétences du TC, en plus de sa position au sein du système des organes de l’Etat. Ces méthodes comprennent, entre autres, la multiplication des juges du Tribunal et l’adaptation d’une loi paralysant l’activité de cette institution.
