The paper sheds light on a number of fundamental features of current Danish public law as to inter alia judicial and political powers. Although the Danish courts have traditionally a prima facie limited political role, the paper discusses signals of change as well as various tensions between judicial and political reasoning. In addition, it highlights a number of current and relatively high-pitched discussions in Danish law as to the degree of transparency and openness within in particular public administration, which has deteriorated in some areas. Finally, the paper revolves around the increasing bulk of legislative activities and the growing influx in its own right of EU law into national law, concluding that the overall balance between complexity and predictability in an overall perspective has shifted towards the former.

Ce rapport met en lumière certains traits fondamentaux du droit public danois actuel concernant, entre autres, les pouvoirs judiciaire et politique. Bien que les juridictions danoises aient traditionnellement un rôle politique limité à première vue, le rapport examine des signes de changement et des tensions variées entre raisonnements judiciaire et politique. En outre, il attire l’attention sur un certain nombre de discussions actuelles et relativement animées en droit danois concernant le degré de transparence et d’ouverture dans l’administration publique en particulier, qui a baissé dans certains domaines. Enfin, le rapport se penche sur l’importance grandissante de l’activité législative et sur l’afflux croissant en soi du droit européen dans le droit national, et il conclut que l’équilibre global entre complexité et prévisibilité, dans une perspective générale, s’est modifié en faveur de la première.
