Bosnia and Herzegovina is a very fragile state. The Constitution (based on the Dayton Agreement of 1995) is very complicated. Its main intent is to uphold the balance between the three constituent ethnic groups, namely the Serbs, the Croats and the Bosniacs. The State B and H is a Federal State. Members are the Croat-Bosniac Federation Bosnia and Herzegovina (FBIH) - which consists of three can¬tons - and the Serb Republika Srpska. These are the two "entities". But there is a third partner, which may be addressed as a "quasi-entity": the "Brčko-District". According to its constitutional basis, the "final award of the Arbitral Tribunal" of 1999, it is an independent city under the sovereignty of the State B and H. Brčko has 88.000 citizens, a parliament and a mayor. Its constitutional and administrative life is a laboratory for experimental peaceful coexistence of three ethnicities. The author assisted as an expert in the establishment of the Parliament and is still doing so.
Bosnien und Herzegowina ist ein zerbrechlicher Staat. Die Verfassung (festgelegt in Friedensabkommen von Dayton 1995) ist äußerst kompliziert. Ihr wesentlicher Zweck ist es, die Balance der drei den Staat "konstituierenden" Volksgruppen, nämlich der Serben, Kroaten und Bosniaken, aufrechtzuerhalten. B und H ist ein Bundesstaat, bestehend aus der "Bundesrepublik B und H" - welche ihrerseits aus zehn Kantonen besteht - und der "Serbischen Republik" (Republika Srpska - RS). Das sind die beiden staatlichen "Entitäten". Aber es gibt einen dritten Partner, den man als "Quasi-Entität" bezeichnen kann: den "Brčko-Distrikt". Nach Maßgabe seiner Verfassungsgrundlage, eines Internationalen Schiedsspruches von 1999, ist der Distrikt eine unabhängige Stadt unter der Souveränität des Gesamtstaates B und H. Brčko hat 88.000 Einwohner, ein Parlament und eine Stadtverwaltung. Das ver¬fas¬sungs- und verwaltungsrechtliche Leben von Brčko kann als ein Laborversuch angesehen werden, wie die drei Volksgruppen friedlich miteinander leben können. Der Verfasser war als Experte beim Aufbau des Parlaments von Brčko beteiligt und erfüllt diese Aufgabe auch gegenwärtig.
