Art. 91b Basic Law was amended in 2014 in order to facilitate the cooperation between the federal and the Länder governments in the promotion of scientific research and teaching. A constitutional controversy emerged on the decision to open the German borders for refugees in the autumn of 2015 but in the end no appeal to the Federal Constitutional Court was lodged. The Federal Constitutional Court stressed in several decisions that it may decide on the limits of the German participation in the European Union. Decisions in the field of state organization concerned autonomous institutions financed by a special levy, the procedure of the assembly electing the Federal President, the duty of neutrality of state organs, the information rights of parliament and the principle of separation of powers. In the field of basic rights the Court decided on the organization of public broadcast companies and on the participation rights of university professors, on the inheritance tax, on the limits of judicial interpretation, on the ban of head scarfs in the civil service and on the level of remuneration of civil servants.
L’article 91b de la Loi fondamentale a été amendé en 2014 afin de faciliter la coopération entre le gouvernement fédéral et les gouvernements des Länder pour la promotion de la recherche et de l’enseignement dans le domaine des sciences. La décision d’ouvrir les frontières de l’Allemagne aux réfugiés à l’automne 2015 a soulevé une controverse constitutionnelle, mais finalement, aucun pourvoi n’a été formé devant la Cour constitutionnelle fédérale. La Cour constitutionnelle fédérale a souligné dans plusieurs arrêts qu’elle pouvait décider sur les limites de la participation allemande à l’Union européenne. Des arrêts rendus dans le domaine de l’organisation de l’Etat ont concerné des institutions autonomes financées par une taxe spéciale, la procédure dans l’assemblée qui élit le président fédéral, le devoir de neutralité des organes de l’Etat, les droits à l’information du parlement et le principe de la séparation des pouvoirs. En matière de droits fondamentaux, la Cour a rendu des arrêts sur l’organisation des sociétés publiques de radiodiffusion et sur les droits de participation des professeurs d’université, sur l’impôt successoral, sur les limites de l’interprétation par les tribunaux, sur l’interdiction du foulard dans la fonction publique et sur le niveau de rémunération des fonctionnaires.
Art. 91b Grundgesetz wurde im Jahr 2014 geändert, um die Kooperation von Bund und Ländern im Bereich der Wissenschaftsförderung zu erleichtern. Die Öffnung der Grenzen für Schutzsuchende im Herbst 2015 führte zu einer verfassungsrechtlichen Kontroverse, die aber letztlich nicht vor dem Bundesverfassungsgericht ausgetragen wurde. Das Bundesverfassungsgericht hat in mehreren Entscheidungen seinen Kontrollanspruch gegenüber der deutschen Mitwirkung in der EU bekräftigt. Seine Entscheidungen zum Staatsorganisationsrecht befassten sich mit der Zulässigkeit autonomer, durch Sonderabgaben finanzierter Anstalten, mit dem Verfahren in der Bundesversammlung, mit der Neutralitätspflicht von Staatsorganen, mit den parlamentarischen Informationsrechten und dem Grundsatz der Gewaltenteilung. Im Bereich der Grundrechte beschäftigte sich das Gericht mit den Anforderungen an die Organisation der Rundfunkanstalten und der Hochschulen, mit den Ausnahmen bei der Erbschaftssteuer, mit den Grenzen gerichtlicher Auslegung, mit dem Verbot von Kopftüchern im öffentlichen Dienst sowie der Höhe der Besoldung im öffentlichen Dienst.
