At the end of 2013 a new federal government came into power. As it is based on a coalition of the two major groups in Parliament, the question came up of how opposition rights can be secured. The Federal Constitutional Court has published important decisions on the protection of human rights in the following fields: equal treatment of marriage and same-sex partnerships, forced medical treatment in psychiatric hospitals, plea bargains in criminal procedures, creation of a national anti-terror database, annulment of a declaration of paternity by a public authority, retroactive effect of tax law and expropriation in favour of a brown coal mine. Two decisions concerning state organisation are reported, on the constitutionality of postal voting and on the observation of deputies by the office for the protection of the Constitution.
Un nouveau gouvernement fédéral est arrivé au pouvoir à la fin de l'année 2013. Etant donné qu'il repose sur la coalition des deux principaux groupes au Parlement, la question de savoir comment garantir les droits de l'opposition s'est posée. La Cour constitutionnelle fédérale a rendu des arrêts importants sur la protection des droits de l'homme dans les domaines suivants: l'égalité de traitement entre le mariage et le partenariat homosexuel, le traitement médical forcé dans les hôpitaux psychiatriques, les ententes relatives au plaidoyer en matière criminelle, la création d'une base de données antiterroriste nationale, l'annulation d'une déclaration de paternité par une autorité publique, l'effet rétroactif de la loi fiscale et l'expropriation en faveur d'une mine de charbon. Deux arrêts relatifs à l'organisation de l'Etat sont signalés, sur la constitutionnalité du vote postal et sur la surveillance des députés par l'office pour la protection de la Constitution.
Am Ende des Jahres 2013 wurde eine neue Bundesregierung auf der Grundlage einer großen Koalition gebildet, was die Frage aufwirft, wie die Rechte der Opposition gesichert werden können. Das Bundesverfassungsgericht fällte wichtige Entscheidungen zum Grundrechtsschutz in Bereichen Gleichbehandlung von Ehe und gleichgeschlechtlicher Partnerschaft, medizinischer Zwangsbehandlung in psychiatrischen Krankenhäusern, Verständigungen im Strafprozess, Zulässigkeit einer zentralen Antiterrordatei, Behördenanfechtung von Vaterschaftserklärungen, Rückwirkung von Steuerrechtsgesetzen und zur Enteignung zugunsten von Braunkohletagebauen. Das Staatsorganisationsrecht betrafen zwei Urteile zur Zulässigkeit der Briefwahl und zur Beobachtung von Parlamentsabgeordneten durch den Verfassungsschutz.
