There were not many significant developments in Romanian administrative law during the years 2021-2022. On the legislative field, the adoption of a new law on anti-doping, governing the structure and operation of administrative jurisdictional bodies and their procedure, and a parliamentary move to minimize bureaucracy deserve special mention. The Constitutional Court issued important decisions meant to correct some normative excesses from the COVID-19 period which were found to be in breach of fundamental rights, and one decision regarding the sanctions to be applied in case of plagiarism. On the interpretation and application of the law, the High Court of Cassation and Justice settled the divergent jurisprudence regarding the scope of the objection of illegality in administrative litigation.
Le droit administratif roumain n’a pas connu beaucoup de développements significatifs au cours des années 2021-2022. Dans le domaine législatif, l’adoption d’une nouvelle loi sur la lutte contre le dopage, régissant la structure et le fonctionnement des organes juridictionnels administratifs et leur procédure, ainsi qu’une initiative parlementaire visant à réduire la bureaucratie méritent une mention spéciale. La Cour constitutionnelle a rendu d’importantes décisions visant à corriger certains excès normatifs de la période covid-19 jugés contraires aux droits fondamentaux, ainsi qu’une décision concernant les sanctions à appliquer en cas de plagiat. En ce qui concerne l’interprétation et l’application de la loi, la Haute Cour de cassation et de justice a réglé les divergences de jurisprudence concernant la portée de l’objection d’illégalité dans les litiges administratifs.
