The Legitimacy of the Local Representative Bodies:
The Case Study of Serbia and Bosnia and Herzegovina

The subject of this paper are the election and dissolution of the local representative body, as well as its relationship to the local executive, as possible sources and conditions of its legitimacy. The authors claim that the legitimacy of the local representative body depends on the method of its election, its ability to come to the end of its legally prescribed term, as well as its ability to become at least equal partner, if not dominant subject, in the relationship with the local executive. The authors use the legal method in order to analyze the relevant legal provisions in the systems of local self-government of Serbia and Bosnia and Herzegovina. At the same time, they use the comparative method, since they try to find similarities and differences between these systems and the systems of local self-government in other former Yugoslav republics.
