The present paper applies the concept of solidarity in an interdisciplinary manner within the international legal community. Solidarity should be regarded as a permanent and continuous process transcending the various regimes of international law. As the omnipotence of states is steadily diminishing and constantly undermined by the emergence of new international actors, solidarity provides the requisite background by reference to which contemporary challenges and needs can be addressed. The dynamic character of solidarity is best illustrated within two international law regimes, namely human rights law and international watercourses law. In the human rights discourse, solidarity highlights the social dimension of human rights and the significance of community involvement in guaranteeing the enjoyment of all human rights. Furthermore, in the context of international watercourses law, solidarity promotes holistic approaches in relation to the management of shared water resources and thus facilitates the achievement of both ecosystemic and anthropocentric goals.
Le présent rapport applique le concept de la solidarité dans une manière interdisciplinaire dans la communauté juridique internationale. La solidarité doit être regardée comme un processus permanent et continu, transcendant les divers régimes du droit international. Comme l'omnipotence des états se réduit régulièrement et est constamment minée par l'émergence d'acteurs internationaux nouveaux, la solidarité fournit le contexte nécessaire par référence auquel il est possible de relever les défis et de répondre aux besoins contemporains. Le caractère dynamique de la solidarité peut être mieux illustré dans le cadre de deux régimes de droit international, notamment celui des droits de l'homme ainsi que celui du droit des cours d'eau internationaux. Dans le discours des droits de l'homme, la solidarité souligne la dimension sociale des droits de l'homme et l'importance de la participation communautaire dans la garantie de la jouissance de tous les droits de l'homme. En outre, dans le contexte du droit des cours d'eau internationaux, la solidarité favorise des approches globales en matière de gestion des ressources partagées d'eau et donc facilite la réalisation d'objectifs tant écosystémiques qu'anthropocentriques.
