Regulatory Impact Assessment (RIA) by Independent Bodies

This paper deals with institutions of Regulatory Impact Assessment (RIA), namely by independent bodies, adjacent to government or parliament. Less quantity, more quality! These are the goals of RIA, be it prospective (ex ante), concurrent with the parliamentary procedure or retrospective (ex post). RIA is in the meantime common to all EU countries. It is not necessary to unfold the methodological and organisational details of RIA. It is, however, noteworthy that some EU States established independent bodies of RIA, which check the draft bills before they are - mostly by governments - initiated in parliament. The paper analyses the idea of independent RIA-bodies and their realisation in the NL, Great Britain, Germany and Sweden. “Regulatory Watch Europe” is the banner under which Europe’s independent National Advisory (RIA) Boards are coordinated to assess and maximise the benefits of the European Smart Regulation agenda and reduce regulatory burdens.
Cet article traite des institutions d’Evaluation de l’impact réglementaire (EIR), notamment par des organes indépendants, appartenant soit au gouvernment soit au parlement. Moins de quantité, plus de qualité! Ce sont les objectifs de l’EIR, qu’elle soit prospective (ex ante), parallèle à la procédure parlementaire ou retrospective (ex post). L’EIR est entre-temps commune à tous les pays de l’UE. Il n’est pas nécessaire de se référer à tous les détails méthodologiques et organisationnels de l’EIR. Il convient, cependant, de noter que certains Etats de l’UE ont etabli des organes indépendants d’EIR, qui contrôlent les projets de loi avant qu’ils soient - principalement par des gouvernements - initiés au parlement. L’article analyse l’idée des organes indépendants d’EIR et leur réalisation aux Pays-Bas, la Grande Bretagne, l’Allemagne et la Suède. “La Veille Réglementaire Europe” est la bannière sous laquelle les Conseils consultatifs nationaux (EIR) de l’Europe sont coordonnés pour évaluer et maximiser le Programme de Réglementation Intelligente Européenne et réduire les charges réglementaires.
