This year’s administrative law chronicle provides an overview of (i) three pieces of legislation that were enacted in 2018 in the public procurement field, which aimed to complement and/or to simplify the application of the Portuguese Public Procurement Code, as amended in 2017 by Decree-Law 111-B/2017, of 31 August 2017; and of (ii) two pieces of legislation that were enacted in 2018 in the environmental field in order to ensure the transposition, respectively, of Directive (EU) 2015/2193, of the European Parliament and of the Council, of 25 November 2015, and of Directive (EU) 2016/2284, of the European Parliament and of the Council, of 14 December 2016. In addition, we take a look over one particular piece of legislation which established the framework for the transfer of legal powers from the direct and indirect administration of the State to local authorities and to inter-municipal entities.
La chronique de droit administratif de cette année donne un aperçu de: a) trois textes législatifs promulgués en 2018 dans le domaine des marchés publics, qui visaient à compléter et/ou à simplifier l’application du Code portugais des marchés publics, modifié en 2017 par le décret-loi 111-B/2017 du 31 août 2017; b) deux actes législatifs adoptés en 2018 dans le domaine de l’environnement afin d’assurer la transposition, respectivement, de la directive (UE) 2015/2193, du Parlement européen et du Conseil, du 25 novembre 2015, et de la directive (UE) 2016/2284, du Parlement européen et du Conseil, du 14 décembre 2016. En outre, nous examinons un texte législatif particulier qui a établi le cadre du transfert des pouvoirs juridiques de l’administration directe et indirecte de l’Etat aux autorités locales et aux entités intercommunales.
