The Multi-faceted Effectiveness of EU Law

Being the ultimate interpreter of EU law, the CJEU has a vital role in establishing not only the ‘content’ of EU law but also how its effectiveness can be attained. Hence, in unpacking the complexity of the EU law effectiveness, the EU jurisprudence on effectiveness should constitute the starting point of the enquiry. Interestingly, such case law is particularly complex and has generated academic controversy. However, currently there is no comprehensive systematisation of this intricated case law. Moreover, recent events such as the rule of law backsliding in some Member States have highlighted the fragility of the effectiveness of EU law. Accordingly, the CJEU jurisprudence on effectiveness deserves renewed attention to assess its pitfalls and successes. This exploratory paper sets the theoretical and analytical foundations to critically assess the EU case law on effectiveness. It discusses the complexity and the academic controversy surrounding the EU case law on effectiveness. Subsequently, it systematises the EU effective­ness principles and critically reflects on the EU peculiar principles of effectiveness.

En tant qu’interprète ultime du droit de l’UE, la CJUE joue un rôle essentiel dans l’établissement non seulement du “contenu” du droit de l’UE, mais aussi de la manière de le rendre efficace. Par conséquent, si l’on veut démêler le problème complexe de l’efficacité du droit européen, il convient de partir de la jurisprudence de la CJUE relative à cette question. Cette jurisprudence est elle-même particulièrement complexe et a suscité des controverses dans la doctrine. Il n’existe toutefois actuellement aucune systématisation complète de cette jurisprudence complexe. En outre, des événements récents, tels que le recul de l’Etat de droit dans certains Etats membres, ont mis en évidence la fragilité de l’efficacité du droit communautaire. Par conséquent, la jurisprudence de la CJUE relative à l’efficacité mérite une at­tention renouvelée afin d’évaluer ses pièges et ses succès. Cet article exploratoire pose les bases théoriques et analytiques d’une évaluation critique de cette jurisprudence. Il examine sa complexité et la controverse académique qui l’entoure. Puis il systématise les principes d’efficacité de l’UE et réfléchit de manière critique sur les principes d’efficacité particuliers de l’UE.
