LA CREATION DE DROIT PAR LE JUGE DE L'UNION EUROPEENNE

In the institutional system of the European Union, as well as within national systems, it is primarily the legislative and regulatory power that is responsible for law-making, the judge being responsible for its implementation and its interpretation. Thus the Treaties frame the powers of the EU judge, by not attributing to him any law-making role. In the framework of his office, the judge seeks to meet this limitation. However, just like the national judge, the judge of the Union can be led to have a much wider role and to proceed to law-making, particularly in the framework of the interpretation of EU law. This creative work is being carried out, however, under control of the legislature that intervenes as a last resort in order to confirm or infirm case-law solutions.
Dans le système institutionnel de l'Union européenne, comme au sein des systèmes nationaux, c'est en premier lieu au pouvoir législatif et réglementaire qu'il appartient de créer le droit, le juge étant quant à lui chargé de sa mise en œuvre et de son interprétation. C'est ainsi que les Traités encadrent les fonctions du juge de l'Union, en ne lui conférant aucun rôle normatif. Dans le cadre de son office, le juge s'attache à respecter cette limitation. Néanmoins, à l'instar du juge national, le juge de l'Union peut être amené à avoir un rôle beaucoup plus étendu et à faire œuvre normative, en particulier à l'occasion de l'interprétation du droit de l'Union. Cette œuvre créatrice se fait toutefois sous le contrôle du législateur qui intervient en dernier ressort pour confirmer ou infirmer les solutions dégagées par la jurisprudence.
