JUDICIAL LEGITIMACY: THE FUNCTIONS OF THE JUDGE

The public standing and reputation of judges is a Europe-wide issue. In the United Kingdom, the judges have cooperated in reducing the mystique which once surrounded their office; but part of the price has been an increasing vulnerability to attack, not all of it justified. The lack of ethnic and gender diversity on the bench is a continuing and genuine problem. But it is eclipsed by a growing measure of disrespect in the printed media, all of it agenda-driven and some of it actively encour¬aged by ministers and politicians, either to earn press approval or to deflect attention from their own shortcomings. The problem which this poses for judges is acute: whether they capitulate to such criticism or resist it, the impartial discharge of their duties becomes harder and their legitimacy more contested.
L'image publique et la réputation des juges sont un problème à l'échelle européenne. Au Royaume-Uni, les juges ont coopéré à la réduction du mystère qui entourait naguère leur fonction; mais une part du prix à payer a été la vulnérabilité accrue aux attaques, pas toujours justifiées. Le manque de diversité ethnique et de parité hommes-femmes dans la magistrature reste un problème permanent et véritable. Mais il est éclipsé par un manque de respect croissant dans la presse écrite, totalement programmé et parfois activement encouragé par les ministres et les hommes politiques, soit pour gagner l'appui de la presse, soit pour détourner l'attention de leurs propres carences. Le problème que cela pose aux juges est aigu: qu'ils capitulent devant la critique ou qu'ils résistent, l'exercice impartial de leurs fonctions devient plus ardu et leur légitimité plus contestée.
