In 2021 the legislation did not significantly affect the field of Administrative Procedure Law, however some amendments were made in order to clarify issues of legal interpretation arising from case law. One was that when the legislator has clarified who is entitled to decide on the disqualification of an authority if there is a ground for exclusion against the authority. On 1st of January 2021, the Act on Sanctions for Administrative Infringements came into force, with which the legislator sought to unify the extensive substantive administrative sanctions legislation. A couple of interesting court (nullity of an administrative act, judicial independence) and Constitutional Court (the right of nationalities to use languages in administrative litigation) decisions were issued during the year, the main principles of which are also presented in this Chronicle about the Hungarian Administrative Law.
En 2021, la législation n’a pas affecté de manière significative le domaine du droit de la procédure administrative, mais certains amendements ont été apportés afin de clarifier des questions d’interprétation juridique découlant de la jurisprudence. Par exemple, le législateur a clarifié qui est habilité à décider de la disqualification d’une autorité s’il existe un motif de l’exclure. Le 1er janvier 2021, la loi sur les sanctions pour les infractions administratives est entrée en vigueur, le législateur ayant cherché à unifier la vaste législation sur les sanctions administratives matérielles. Quelques décisions intéressantes des tribunaux (nullité d’un acte administratif, indépendance judiciaire) et de la Cour constitutionnelle (droit des nationalités d’utiliser leur langue dans les litiges administratifs) ont été rendues au cours de l'année, dont les principes essentiels sont également présentés dans cette Chronique sur le droit administratif hongrois.
