The article analyses the character and essence of the general principles of the administrative procedure provided for in the Polish Code of administrative procedure. It also presents the catalog of these principles and their content. In this field, it also refers to the opinions presented by Polish legal doctrine as well as to the case law of the administrative courts. The main institutions of administrative law, concerned by the above principles, are also being discussed in this framework. The background for the ideas exposed is the essence of the jurisdictional administrative procedure. The problem of the general principles of the administrative procedure is also being studied from the point of view of values protected by administrative law, especially in the fields where public interest encroaches upon individual interests. The author also refers to provisions of the European Code of Good Administrative Behaviour, adopted on 6 September 2001 by the European Parliament. Examined through that prism, the article has a comparative character.
L'article analyse le caractère et l'essence des principes généraux de la procédure administrative fixés dans le Code polonais de procédure administrative. Il présente aussi le catalogue de ces principes et leur teneur. Dans ce domaine, il se réfère aux avis exposés dans la doctrine polonaise du Droit ainsi qu'à la jurisprudence des tribunaux administratifs. Il y est également question des principales institutions du Droit administratif concernées par les principes ci-dessus. Le fond pour les idées exposées est l'essence de la procédure juridictionnelle administrative. Le problème des principes généraux de la procédure administrative est étudié aussi du point de vue des valeurs protégées dans le Droit administratif, surtout dans les domaines où l'intérêt public empiète sur les intérêts individuels. L'auteur se réfère aux dispositions du Code européen de bonne conduite administrative voté le 6 septembre 2001 par le Parlement européen. Examiné sous cet aspect, l'article a un caractère comparatif.
