From a Member State perspective, the "judicial dialogue" between European and national courts takes place mainly in two phases: a bottom-up one, in which the national courts address the European Court of Justice through the mechanism of the preliminary ruling; a top-down one, in which, on the one hand, national judges are bound to apply the European Union law as it has been interpreted by the European Court of Justice and, on the other hand, they are supposed to enforce the judgments of the European Court of Human Rights.

Du point de vue d'un Etat membre, le "dialogue entre juges" entre juridictions européennes et nationales a lieu principalement en deux phases: une bottom-up, dans le cadre de laquelle les juridictions nationales s'adressent à la Cour de Justice de l'Union européenne à travers le mécanisme du renvoi préjudiciel; une top-down, dans le cadre de laquelle, d'une part, les juges nationaux sont tenus d'appliquer le droit de l'Union européenne comme il a été interprété par la Cour de Justice de l'Union européenne et, d'autre part, ils sont censés de faire appliquer les jugements de la Cour européenne des droits de l'homme.
