The Development of Swedish Administrative Law during the Last 30 Years:
Towards Judicialisation and Constitutionalisation

The evolution of Swedish administrative law during the last decades may be said to have been characterised by two principal phenomena. One is a process of judicialisation through the expansion of judicial power of the administrative courts and through their liberation from the administrative-political sphere. The second phenomenon, constitutionalisation, has expressed itself by improvements in the constitutional review of laws, including administrative laws, and by a constitutionalisation of the practice of the courts through the use of bills of rights. Moreover, constitutionalisation of administrative law has occurred through the introduction of constitutional principles into the Swedish Administrative Procedure Act. Europeanisation has largely influenced both the process of judicialisation and the process of constititutionalisation of Swedish administrative law.
On peut dire que l’évolution du droit administratif suédois au cours des dernières décennies a été caractérisée par deux phénomènes principaux. Le premier est un processus de judiciarisation, par l’extension du pouvoir des juridictions administratives et par leur libération de la sphère politico-administrative. Le second phénomène, celui de constitutionnalisation, s’est exprimé par un renforcement du contrôle constitutionnel des lois, y compris des lois à caractère administratif, et par une constitutionnalisation de la pratique des Cours au travers de l’utilisation par celles-ci de déclarations des droits. En outre, la constitutionnalisation du droit administratif s’est produite par l’introduction de principes constitutionnels dans la loi suédoise sur la procédure administrative. L’européanisation a largement influencé à la fois le processus de judiciarisation et le processus de constitutionnalisation du droit administratif suédois.
