The Danish Impeachment Court – An Outdated Institution?

The article describes the Danish model for impeachment of ministers: The Impeachment Court. It asks the question whether such an institution – a bastard between a judicial and a political body – has become outdated. States seem increasingly to abandon the use of impeachment courts, whether de jure or de facto. Even so, Denmark has seen a kind of “revival” of the Impeachment Court, which for long was considered obsolete. However, the similarities between the two most recent Danish cases indicate that the “system” learns little from impeachment cases. On this background, the article considers viable alternatives to Impeachment Courts when ministers need to be held accountable.

L’article décrit le modèle danois de mise en accusation des ministres, avec la Cour de mise en accusation. Il pose la question de savoir si une telle institution – un bâtard entre un organe judiciaire et un organe politique – est devenue obsolète. Les Etats semblent de plus en plus renoncer à l’utilisation des cours de mise en accusation, que ce soit de jure ou de facto. Pourtant, le Danemark a connu une sorte de “renaissance” de la Cour de mise en accusation, longtemps considérée comme obsolète. Toutefois, les similitudes entre les deux affaires danoises les plus récentes indiquent que le “système” ne tire que peu d’enseignements des affaires de mise en accusation. Dans ce contexte, l’article envisage des alternatives viables aux cours de mise en accusation lorsque des ministres doivent rendre des comptes.
