The progressive introduction of corporate liability in criminal systems has narrowed the relation between criminal Law and administrative sanctioning Law. This study analyses the implications that such novel legislation may have in certain areas of administrative offences, particularly with regard to its definition. Specifically, it sets out a response to the question of what criteria should be followed when attributing criminal liability under administrative sanctioning Law, the question of which natural persons may administratively implicate the legal person, and what the requirements are for doing so.

L'introduction progressive de la responsabilité collective dans les systèmes pénaux a limité la relation entre droit pénal et droit des sanctions administratives. Cette étude analyse les implications qu'une législation originale en ce sens pourrait avoir dans certains domaines des infractions administratives, en particulier pour ce qui est de sa définition. Plus spécialement, elle propose une réponse à la question de savoir quels critères il conviendrait de suivre quand on attribue une responsabilité pénale en vertu du droit des sanctions administratives, à la question de savoir quelles personnes physiques pourraient administrativement impliquer la personne morale, et dans quelles conditions.
