The study presents significant developments in the constitutional field in Romania in 2019, a year influenced by electoral competition, due to the elections for the European Parliament and for the office of President of Romania which took place in the same year, as well as the preparation of the parliamentary elections in 2020. The political discourse, focused on the issue of integrity in public office, fighting corruption, and limiting the Government’s legislative power, was reflected in other acts with political and legal significance, such as initiatives to revise the Constitution and the advisory referendum initiated by the President of Romania. In this context, landmarks from the jurisprudence of the Constitutional Court are presented, especially regarding the referendum, the revision of the Constitution, and the elections for the office of President of Romania.
L’étude présente les développements significatifs dans le domaine constitutionnel en Roumanie en 2019, année marquée par la compétition électorale en raison des élections au Parlement européen et au poste de président de la Roumanie, qui ont eu lieu la même année, et de la préparation des élections législatives de 2020. Le discours politique, axé sur la question de l’intégrité dans la fonction publique, la lutte contre la corruption et la limitation du pouvoir législatif du gouvernement, s’est reflété dans d’autres actes ayant une signification politique et juridique, tels que les initiatives de révision de la Constitution et le référendum consultatif initié par le président de la Roumanie. Dans ce contexte, l’étude présente certains jalons de la jurisprudence de la Cour constitutionnelle, notamment en ce qui concerne le référendum, la révision de la Constitution et l’élection du président de la Roumanie.
