It is only two decades ago since Georgia started the development of an independent and democratic state. In order to reach the internationally recognized standards of democracy, Georgia has to establish a high legal culture and supremacy of law on its territory. This cannot be achieved without the existence of an independent and impartial judicial system. For this purpose, state must ensure the establishment of a high level of social, economic and legal guarantees for courts and their members. The Constitutional Court of Georgia is one of the main institutions providing important guarantees to meet the requirements of the Constitution. Hence it is essential to ensure a high degree of independence of the Constitutional Court. That is why this article is focused on presenting the main guarantees of independence of the Constitutional Court and on underlining the main legal norms which upheld the important aspects of independence of the Constitutional Court.
La Géorgie a commencé à développer un Etat indépendant et démocratique depuis deux décennies seulement. Afin d'atteindre les standards internationaux reconnus en matière de démocratie, la Géorgie doit établir une culture juridique élevée et la primauté du droit sur son territoire. Cela ne pouvait se faire sans l'existence d'un système judiciaire indépendant et im¬partial. A cette fin, l'Etat doit garantir la création d'un niveau élevé de garanties sociales, économiques et juridiques pour les tribunaux et leurs membres. La Cour constitutionnelle géorgienne est l'une des principales institutions à prévoir des garanties importantes afin de répondre aux exigences de la Constitution. Il est donc essentiel que la Cour constitutionnelle jouisse d'un degré élevé d'indépendance. C'est pourquoi le présent article s'attache à présenter les principales garanties d'indépendance de la Cour constitutionnelle et à souligner les principales normes juridiques qui ont soutenu les aspects importants de l'indépendance de la Cour constitutionnelle.
