This chronicle analyzes the decisions of the Constitutional Council rendered in 2020 and especially in 2021. These years were marked in particular by the consolidation of the litigation relating to the shared initiative referendum (decisions RIP) and the preparation of the presidential election by the Constitutional Council, judge of the election (decisions concerning the list of candidates authorized to run and this relating to the presentation of candidates, so-called “sponsorships”). Finally, if the year 2020 marks a decrease both in the a priori and in the a posteriori litigation, undoubtedly due to the very particular period of the health crisis, the year 2021 shows on the contrary an increase in these litigations in comparison to the two years preceding it.
Cette chronique analyse les décisions du Conseil constitutionnel rendues au cours de l’année 2020 mais surtout de l’année 2021. Ces années ont notamment été marquées par la consolidation du contentieux relatif au référendum d’initiative partagée (décisions RIP) et la préparation de l’élection présidentielle par le Conseil constitutionnel, juge de l’élection (décisions à propos de la liste des candidats autorisés à se présenter et de celle relative à la présentation des candidats, dite “parrainages”). Enfin, si l’année 2020 marque une baisse du contentieux tant a priori qu’a posteriori, sans doute due à la période très particulière de la crise sanitaire, l’année 2021 montre à l’inverse une croissance de ces contentieux par rapport aux deux années la précédant.
