CONSTITUTIONAL AND HUMAN RIGHTS IN GREECE:
A SHORT ACCOUNT OF THEIR ORIGINS
AND DEVELOPMENT IN THE GREEK LEGAL SYSTEM

This paper analyses the basic features of the fundamental rights system of the Greek legal order from four diverse and yet interconnected standpoints. Thus, first the evolution of fundamental rights protection is examined in the framework of the Greek constitutional history, from the early 19th century until today. Secondly, the influence of International Law, the European Convention on Human Rights and European Union Law on the constitutional and human rights protection in Greece is examined with specific paradigms from the Greek jurisprudence and legislation. Moreover, the functions of the fundamental rights as have been developed in the Greek legal order (symbolic, guaranteeing, legitimizing effect) as well as the legal sources of their protection (e.g. Constitution and private law) are presented along with a case study of the mostly litigated in Greece constitutional rights. Lastly, the system of judicial review in Greece as a guarantor for the application of constitutional and human rights is critically reviewed.
Cet article analyse les caractéristiques essentielles du système des droits fondamentaux de l'ordre juridique grec sous quatre angles différents mais liés entre eux. Il examine donc, d'abord, l'évolution de la protection des droits fondamentaux dans le cadre de l'histoire constitutionnelle grecque du début du XIXe siècle à nos jours. Deuxièmement, il étudie l'influence du droit international, de la Convention européenne de sauvegarde des droits de l'homme et du droit de l'Union européenne sur la protection des droits constitutionnels et de l'homme en Grèce, avec des exemples spécifiques tirés de la jurisprudence et de la législation grecques. Ensuite, il présente les fonctions des droits fondamentaux telles qu'elles se sont développées dans l'ordre juridique grec (effet symbolique, de garantie, de légitimation) ainsi que les sources juridiques de leur protection (i.e. Constitution et droit privé), avec une étude de cas des droits constitutionnels les plus contestés en Grèce. Enfin, il soumet à un examen critique le système de contrôle judiciaire en Grèce en tant que garant de l'application des droits constitutionnels et de l'homme.
