Administrative Procedures and Emergencies under Spanish and EU Law

In case of emergency public authorities can take extraordinary measures, which alter the balance struck between the relevant constitutional principles in ordinary situations. This has also an effect on procedures for the adoption of administrative rules and decisions. This article studies five typical manifestations of this process in view of the measures taken to cope with the health, economic and social crisis brought about by COVID-19: expediting, streamlining, staying, replacing, and removing administrative procedures.
En cas d’urgence, les autorités publiques peuvent prendre des mesures exraordinaires, qui modifient l’équilibre établi entre les principes constitutionnels pertinents dans les situations ordinaires. Cela a également un effet sur les procédures d’adoption de règles et de décisions administratives. Cet article étudie cinq manifestations typiques de ce processus au regard des mesures prises pour faire face à la crise sanitaire, économique et sociale provoquée par la COVID-19: l’accélération, la rationalisation, la suspension, le remplacement et la suppression des procédures administratives.
