The chronicle covers two years – 2023 and 2024 – and (intentionally) approaches diverse subjects. The first section analyzes the reform of the Public-Private Partnerships legislation, aimed to boost the investment in major public projects. The second section addresses two examples of judicial dialogue between the national administrative courts and the two European courts on matters which imply restrictions of fundamental rights deriving from the legislation on integrity in public office – conflict of interests and confiscation of unjustified wealth. The third section approaches a topic which became much disputed lately in European democracies, on restrictions of the right of extremist candidates to run for election.

La chronique couvre deux années – 2023 et 2024 – et aborde (intentionnellement) divers sujets. La première section analyse la réforme de la législation sur les partenariats public-privé, visant à stimuler l’investissement dans les grands projets publics. La deuxième section traite de deux exemples de dialogue judiciaire entre les juridictions administratives nationales et les deux cours européennes dans des affaires impliquant des restrictions aux droits fondamentaux découlant de la législation sur l’intégrité dans la fonction publique – conflit d’intérêts et confiscation de richesse injustifiée. La troisième section aborde un sujet qui est devenu très débattu récemment dans les démocraties européennes, concernant les restrictions au droit pour les candidats extrémistes de se présenter aux élections.
