This chronicle is devoted to actual amendments of the administrative law occurred in the field of state antimonopoly control and in public and public-corporate procurement in 2017 in Russia. Amendments to the federal law “On competition defense”, and also to the Code of the Russian Federation on administrative offenses are analyzed with regard to the competition area. Also, the clarifications of the Federal Antimonopoly Service of Russia on the calculation of losses arising in connection with violations of antimonopoly legislation are considered. Finally, the main developments and changes to the regulations governing the contract system in procurement and public-corporate procurement are analyzed.
Cette chronique est consacrée aux amendements actuels en droit administratif dans le domaine du contrôle étatique antimonopoles et des marchés publics et publics-privés en 2017 en Russie. Des amendements à la Loi fédérale “Sur la défense de la concurrence” ainsi qu’au Code des infractions administratives de la Fédération de Russie sont analysés en ce qui concerne le domaine de la concurrence. De même, les éclaircissements du Service fédéral antimonopoles de la Russie sur le calcul des pertes découlant des violations de la législation antimonopole sont examinés. Enfin, l’évolution et les modifications principales de la réglementation du régime de contrat dans le domaine de la passation des marchés publics et publics-privés sont décrites.
Эта хроника посвящена актуальным изменениям административно-правового регулирования государственного антимонопольного контроля в России, а также сферы государственных и государственно-корпоративных закупок в 2017 г. В области конкуренции проанализированы изменения в Федеральный закон «О защите конкуренции», а также Кодекс Российской Федерации об административных правонарушениях. Кроме того, рассмотрены разъяснения Федеральной антимонопольной службы России по вопросам расчета убытков, возникающих в связи с нарушениями антимонопольного законодательства. Также рассмотрены основные новации и изменения в нормативные правовые акты, регулирующие контрактную систему в сфере закупок, а также государственно-корпоративные закупки.
