This report gives an overview on the most important developments in constitutional law and practice in the Federal Republic of Germany in the years 2008-2010. During this period, four constitutional amendments were adopted. They related to Parliament rights in EU matters, the organisation of the aviation administration, the introduction of a debt limit to the budgets of the Federation and the Federal States and the creation of a total of three new joint tasks. Furthermore, twelve particularly important decisions of the Federal Constitutional Court are presented. They relate to the admissibility of online searches, the operation of AWACS aircrafts over Turkey, the negative voting weight resulting from electoral law, the compatibility of the commuter tax allowance with the principle of equality, the use of voting computers, the powers of a parliamentary committee of inquiry, the Lisbon treaty, the unequal treatment of marriages and registered civil partnerships, the shop opening hours on Sundays and holidays, the amount of unemployment benefits, the admissibility of data retention and the control of competences over the European Court of Justice.
Der Bericht gibt einen Überblick über wichtige Ereignisse im Verfassungsrecht und in der Verfassungspraxis der Bundesrepublik Deutschland in den Jahren 2008-2010. In dieser Zeit wurden vier Verfassungsänderungen verabschiedet. Sie betrafen die Rechte des Parlaments in EU-Angelegenheit, die Organisation der Luftverkehrsverwaltung, die Einführung einer Verschuldungsbremse für die Haushalte von Bund und Ländern sowie die Schaffung von insgesamt drei neuen Gemeinschaftsaufgaben. Vorgestellt werden außerdem zwölf besonders wichtige Entscheidungen des Bundesverfassungsgerichts. Sie betrafen sie Zulässigkeit der Online-Durchsuchung, den Einsatz von AWACS-Flugzeugen über der Türkei, das negative Stimmgewicht als Effekt des Wahlrechts, die Vereinbarkeit der steuerrechtlichen Pendlerpauschale mit dem Gleichheitssatz, die Nutzung von Wahlcomputern, die Rechte von parlamentarischen Untersuchungsausschüssen, den Lissabon-Vertrag, die Ungleichbehandlung von Ehe und eingetragener Lebenspartnerschaft, die Ladenöffnungszeiten an Sonn- und Feiertagen, die Höhe des Arbeitslosengelds II, die Zulässigkeit der Vorratsdatenspeicherung und die Kompetenzkontrolle gegenüber dem EuGH.
