Weighing ECtHR Decisions against National Constitution:
Russian Experience

Elvira R. Gadelshina

LL.M. (Frankfurt), associate at Khrenov and Partners

The European Court of Human Rights and the Russian Constitutional Court share a history of conflicting decisions and divergent approaches to the interpretation and application of rules of law. The Constitutional Court has recently declared itself ready for a “legitimate compromise” for the sake of maintaining the European system of human rights protection, with the reservation that the Court will autonomously determine “the extent of its readiness for such compromise”, with the limits of compromise being drawn by the national Constitution. This article endeavors to briefly discuss the status quo and possible future development of the relationship between the ECtHR and Russia’s Constitutional Court.
