The crisis started in 2006 has represented an important phase in the European Union's (EU) experience: the European Banking Union (EBU) framework, adopted according to Arts. 114 and 127, par. 6, Treaty on the Functioning of the European Union (TFEU), represents one of the most origial and strong European answers toward this crisis: the paper analyzes the originality of the public law system connected to the EBU and examines the Italian experience considered as an example of the non-reducible space remaining to the State in this framework.

La crise qui a éclaté en 2006 a représenté une phase importante de l'expérience de l'Union européenne: le cadre de l'Union bancaire européenne (UBE) adopté conformément aux articles 114 et 127, paragraphe 6, du Traité sur le fonctionnement de l'Union européenne (TFUE) illustre l'une des réponses européennes les plus originales et les plus fortes à cette crise: l'étude analyse l'originalité du système de droit public lié à l'UBE et examine l'expérience italienne, considérée comme un exemple de l'espace non réductible restant à l'Etat dans ledit cadre.
