The article discusses questions of expressed wishes of a patient and the possibilities to refuse treatment before such circumstances for its provision arise. It is applied through the institute of waiver, a private-law instrument for giving up rights in advance, which in the Slovak legal system should be considered in respect of the duty to provide healthcare lege artis (in the regime of public law and as the expression of public interest).
