This study examines the compatibility of Article 26 of the Greek Inheritance Tax Code with the free movement of capital, on the occasion of the CJEU decision of 26 May 2016 in Case C-244/15 European Commission v. Hellenic Republic. In the view expressed in the present study, this provision is designed in a way that causes discriminations against nationals of other Member States who are not residents of Greece during the time of acquisition. It is examined if the observed restriction of the free movement of capital can be justified according to the provisions of the Treaty. The analysis shows that the conditions for the application of the different treatment which is permitted pursuant to Article 65 TFEU do not apply.

Cette étude examine la compatibilité de l’article 26 du Code grec des droits de succession avec la libre circulation des capitaux, à l’occasion de l’arrêt rendu par la CJUE le 26 mai 2016 dans l’affaire C-244/15, Commission/Grèce. Selon l’opinion exprimée dans la présente étude, la manière dont cette disposition est conçue crée des discriminations envers les nationaux des autres Etats membres qui ne résident pas en Grèce au moment de l’acquisition. L’étude examine si la limitation constatée à la libre circulation des capitaux peut se justifier au regard des dispositions du traité. L’analyse montre que les conditions de l’application d’un traitement différent permis conformément à l’article 65 TFUE ne s’appliquent pas.
