JUDICIAL ACTIVISM OF CONSTITUTIONAL COURTS

This paper is a broad comparative analysis in the field of rule of law. In this article the author argues that the Europeanisation and European Integration of the country is best served when Constitutional Courts become judicially active. Drawing on a wide array of case law from various Central, East and Southeast European Constitutional Courts, the paper illustrates that European Constitutional Courts are far more than guardians of national constitutions, but actors in the European Integration process of their countries. The paper discusses the role of the Constitutional Court of Georgia in the European Integration process as well.
