The dialogue between national and international judges is of utmost importance both for national legal systems in order to better reach international standards and to establish a universal understanding of human rights, and for the international legal order to be duly and effectively applied. As for Turkey, such dialogue carries much greater importance than any other nation while taking into account the caseload of the ECtHR regarding cases against her. In that sense, it is vital to focus on how much and on what basis national judges internalise international/supranational le­gal order. For that purpose, the dialogue between national and international judges in the case of Turkey is examined in this study by placing international legal order in Turkish law under Article 90 of the Turkish Constitution, and by using international conventions and case-law by national judges.

Le dialogue entre juges nationaux et internationaux est d'une importance capitale pour les systèmes juridiques nationaux, pour mieux atteindre les normes internationales et établir une interprétation universelle des droits de l'homme, mais aussi pour que l'ordre juridique international soit dûment et efficacement appliqué. Pour ce qui est de la Turquie, un tel dialogue acquiert une importance bien plus grande que pour toute autre nation, compte tenu de la jurisprudence de la CourEDH dans les procès engagés contre elle. En ce sens, il est vital de mettre l'accent sur l'étendue et la base de l'intégration de l'ordre juridique international/supranational par les juges nationaux. Dans ce but, cette contribution étudie le dialogue entre les juges nationaux et internationaux dans le cas de la Turquie en examinant comment l'ordre juridique international est intégré en droit turc sous l'angle de l'article 90 de la Constitution turque et en examinant la manière dont les juges nationaux utilisent les conventions et la jurisprudence internationales.
