Factual Administrative Conduct and Judicial Review in EU Law

The EU’s internal system of judicial review was designed to offer protection against acts and decisions of EU institutions and bodies that have binding legal effect. Therefore, it is almost impossible for applicants to persuade the Court of Justice to review the legality of administrative conduct that is factual in nature and/or effect. However, under Article 47(1) of the Charter of Fundamental Rights this déni de justice has become untenable. This article examines the lack of adequate judicial review of and protection against factual conduct as well as instruments to close that gap in the EU’s ‘complete system of judicial review’ promised by the Court of Justice since its 1986 Les Verts case.

Le système communautaire interne de contrôle juridictionnel a été élaboré pour offrir une protection contre des actes et décisions des institutions et organes de l’UE ayant des effets juridiques contraignants. Par conséquent, il est presque impossible pour les requérants de persuader la Cour de justice de contrôler la légalité d’une conduite administrative qui est factuelle en nature et/ou en effet. Cependant, en vertu de l’article 47, paragraphe 1, de la Charte des droits fondamentaux, ce déni de justice est devenu intenable. Le présent article examine l’absence de contrôle juridictionnel adéquat et de protection contre une conduite factuelle ainsi que les instruments pour combler cette lacune dans le “système complet de contrôle juridictionnel” de l’UE promis par la Cour de justice depuis l’affaire Les Verts en 1986.
