General Conclusions
Judge at the Spanish Supreme Court
This text reflects the oral conclusions presented at the end of the EGPL reunion in September 2021. Given the broad variety of topics touched by the different speakers, these conclusions deal in particular with two questions: the legal problems posed by the practice of triage (i.e. selecting which patients can be attended when not all of them can be treated) and the ambiguities of the “state” as guarantor of last resort. The conclusions also include a reference to their author’s professional experience during the pandemic.
Ce texte reflète les conclusions orales présentées à l’issue de la réunion du GEDP en septembre 2021. Compte tenu de la grande variété des sujets abordés par les différents intervenants, ces conclusions traitent plus particulièrement de deux questions: les problèmes juridiques posés par la pratique du triage (c’est-à-dire la sélection des patients qui peuvent être pris en charge quand tous ne peuvent pas l’être) et les ambiguïtés de “l’Etat” en tant que garant de dernier recours. Les conclusions font également mention de l’expérience professionnelle de leur auteur pendant la pandémie.
