SOLIDARITY BETWEEN STATES
IN THE GLOBAL LEGAL SPACE

What does solidarity exactly mean in international law? There is no conclusive answer to this question, because solidarity can often wear more coats and operate both as a value and as a principle. To address these issues, this paper will first provide some historical and theoretical remarks on the idea of solidarity and its multiple meanings. Thereafter, it will focus on the solidarity both as a value, in its constitutional dimension, and as a principle, in its administrative dimension. It will then examine the ambiguous relationship between solidarity and sovereignty. Finally, the key role of solidarity in the global legal space will be outlined: if fraternité helped French legal scholars to build domestic administrative law to also be a machine that addresses collective interests, solidarity appears to be capable of strengthening the normative claims of many of the legal projects ideated to tame global governance.
Que signifie-t-elle la solidarité en droit international? Il n'y a pas de réponse conclusive à cette question, car la solidarité peut avoir plusieurs facettes et opérer à la fois comme une valeur et un principe. Pour que ces questions soient adressées, ce rapport fournira d'abord quelques remarques historiques et théoriques concernant l'idée de la solidarité et ses significations multiples. Il va mettre par la suite l'accent sur la solidarité à la fois comme une valeur, dans sa dimension constitutionnelle, et comme un principe, dans sa dimension administrative. Il va ensuite examiner la relation ambiguë entre solidarité et souveraineté. Enfin, va être présenté le rôle-clé de la solidarité dans l'espace juridique mondial: si la fraternité a aidé les juristes français à construire le droit administratif interne pour qu'il devienne également une machine répondant aux intérêts collectifs, la solidarité se présente comme capable de renforcer les exigences normatives d'un grand nombre de projets élaborés pour apprivoiser la gouvernance mondiale.
