The Right to Private and Family Life in the Czech Republic
and its Constitutional Protection

The article presents the right to private and family life as a cornerstone of human rights protection and is particularly focused on the main features and current disputable issues of its constitutional protection in the Czech Republic as an example of an EU Member State since 2004 with democratic transition experience since 1989. The membership of the Council of Europe and the adherence to the Convention for the Protection of Human Rights and Fundamental Freedoms were very important steps in this process and were taken quite early in the beginning of 1990s. Against this backdrop, the article describes the national constitutional law provisions as well as their reflection in the recent European Court of Human Rights case law. Through the perspective of some selected influential cases, the shared views of the national and international human rights judicial protection are traced.
L’article présente le droit à la vie privée et familiale comme une pierre angulaire de la protection des droits de l’homme, et il se concentre en particuliersur les principales caractéristiques et les questionslitigieuses actuelles de sa protection constitutionnelle en République tchèque, exemple d’un Etat membre de l’UE depuis 2004 avec une expérience de transition démocratique depuis 1989. La participation au Conseil de l’Europe et l’adhésion à la Convention de sauvegarde des droits de l’homme et des libertés fondamentales ont constitué des étapes très importantes dans ce processus et ont été franchies assez tôt, au début des années 1990. Dans ce contexte, l’article décrit les dispositions du droit constitutionnel national ainsi que la manière dont elles se reflètent dans la jurisprudence récente de la Cour européenne des droits de l’homme. Une sélection de quelques affaires importantes permet de retracer les points de vue partagés par la protection judiciaire nationale et internationale en matière de droits de l’homme.
