Public Law, the Crises, the Current Crisis -

The Economic Crisis is a crisis of the rule of law and democracy. To overcome the Crisis, we need various measures - and a paradigm shift: borrowing must be limited to exceptional situations and specific reasons. Furthermore, a legal way to overcome the Crisis is required. The period of not obeying the law - of undermining the rule of law - has come to an end. The Fiscal Compact and the ESM might be a step in the right direction. Maybe we need other transitional rules to address the Crisis effectively. But the legal rules in force have to be complied with. That would strengthen the credibility and the confidence in the Euro area and consequently reinforce the stability of the Euro. The European Union is a Community of law. Without the law, there is no European Union and no legitimate power. The Law is essential to protect freedom and equality.
La crise économique est une crise de l'Etat de droit et de la démocratie. Pour la surmonter, nous avons besoin de diverses mesures - et d'un changement de paradigme: l'emprunt doit être limité à des situations exceptionnelles et à des raisons spécifiques. En outre, il faut une voie légale pour dépasser la crise. La période de désobéissance à la loi - et de minage de l'Etat de droit - est arrivée à sa fin. Le Pacte fiscal et le Mécanisme européen de stabilité pourraient être un pas dans le bon sens. Peut-être avons-nous besoin d'autres règles transitoires pour faire face de manière efficace à la crise. Mais les règles juridiques en vigueur doivent être respectées. Cela renforcerait la crédibilité et la confiance dans la zone euro, et donc la stabilité de l'euro. L'Union européenne est une communauté de droit. Sans le droit, il n'y a pas d'Union européenne ni de pouvoir légitime. Le droit est essentiel pour protéger la liberté et l'égalité.
